ACTION:

Notice of limitation on claims for judicial review.

SUMMARY:


[top] The FHWA, on behalf of the Georgia Department of Transportation (GDOT), is issuing this notice to announce actions taken by GDOT and other Federal agencies that are final agency actions. These actions relate to the proposed highway project, which extends on State Route (SR) 9 from its crossing of the Chattahoochee River northward to its intersection with SR 120 for a total length of 1.1 miles. The page 28851 project also includes improvements to a 0.4-mile east-west segment along Azalea Drive/Riverside Road from just west of SR 9 to Riviera Road. Those actions grant licenses, permits, and approvals for the project.

DATES:

By this notice, the FHWA, on behalf of GDOT, is advising the public of final agency actions subject to 23 U.S.C. 139(l)(1). A claim seeking judicial review of the Federal Agency actions on the listed highway project will be barred unless the claim is filed on or before November 28, 2025. If the Federal law that authorizes judicial review of a claim provides a time period of less than 150 days for filing such claim, then that shorter time period still applies.

SUPPLEMENTARY INFORMATION:

Notice is hereby given that GDOT and other Federal agencies have taken final agency actions subject to 23 U.S.C. 139(l)(1) by issuing licenses, permits, or approvals for the proposed improvement highway project. The actions by GDOT and other Federal agencies on the project, and the laws under which such actions were taken are described in the FONSI approved on June 26, 2025, and in other project records for the listed project. The FONSI and other documents for the listed project are available by contacting GDOT at the address provided above.

The project subject to this notice is:

Project Location: The project limits include removal of the existing three-lane reversible lane system along SR 9 and construction of a four-lane divided highway between the SR 9 bridge over the Chattahoochee River and SR 120/Marietta Highway, including grade separation of SR 9 over Azalea Road and Riverside Drive, as well as two dual-lane roundabouts on SR 9 and a single-lane roundabout on Riverside Road/Azalea Drive. This four-lane section of SR 9 will connect to the existing four-lane sections south of Riverside Road/Azalea Drive and north of SR 120/Marietta Highway. The project also will provide new and enhance existing sidewalks and multi-use trails along the project corridor.

Project Actions: This notice applies to the FONSI and all other Federal agency licenses, permits, or approvals for the listed project as of the issuance date of this notice including but not limited to the Section 4(f) Resource Approval and all laws under which such actions were taken, including but not limited to:

1. General: National Environmental Policy Act (NEPA) [42 U.S.C. 4321 et seq. ]; Federal-Aid Highway Act (FAHA) [23 U.S.C. 109 and 23 U.S.C. 128]; 23 CFR part 771.
