j. Town of Waterville filed its request to use the Traditional Licensing Process onMay 7, 2012. Town of Waterville provided public notice of its request on June 6,2012. In a letter dated July 2, 2012, the Director of the Division of HydropowerLicensing approved Town of Waterville's request to use the Traditional LicensingProcess.
k. With this notice, we are initiating informal consultation with: (a) The U.S. Fish andWildlife Service and NOAA Fisheries under section 7 of the Endangered SpeciesAct and the joint agency regulations thereunder at 50 CFR, Part 402; (b) NOAAFisheries under section 305(b) of the Magnuson-Stevens Fishery Conservation andManagement Act and implementing regulations at 50 CFR 600.920; and (c) theVermont State Historic Preservation Officer, as required by section 106, NationalHistorical Preservation Act, and the implementing regulations of the AdvisoryCouncil on Historic Preservation at 36 CFR 800.2.
l. Town of Waterville filed a Pre-Application Document (PAD; including a proposedprocess plan and schedule) with the Commission, pursuant to 18 CFR 5.6 ofthe Commission's regulations.
