SUMMARY:

EPA has authorized its contractor SyracuseResearch Corporation (SRC), of Syracuse, NY, access to information whichhas been submitted to EPA under sections 4, 5, 6, 8, and 21 of the ToxicSubstances Control Act (TSCA). Some of the information may be claimed ordetermined to be Confidential Business Information (CBI).

DATES:

Access to the confidential data will occur nosooner than April 21, 2004.

SUPPLEMENTARY INFORMATION:

I. General Information

A. Does this Notice Apply to Me?

This action is directed to the public in general. This action may,however, be of interest to those persons who are or may be required toconduct testing of chemical substances under TSCA. Since other entitiesmay also be interested, the Agency has not attempted to describe all thespecific entities that may be affected by this action. If you have anyquestions regarding the applicability of this action to a particularentity, consult the person listed under FOR FURTHER INFORMATIONCONTACT .

B. How Can I Get Copies of this Document and Other RelatedDocuments?

1. Docket. EPA has established an official public docketfor this action under docket identification (ID) numberOPPT-2003-0004. The official public docket consists of thedocuments specifically referenced in this action, any public commentsreceived, and other information related to this action. Although a part ofthe official docket, the public docket does not include CBI or otherinformation whose disclosure is restricted by statute. II. What Action is the Agency Taking?

Under Contract Number EP-W-04-019, SRC of 301Plainfield Road, Suite 350, Syracuse, NY, will assist EPA in by providingexpertise in the health and environmental sciences, including biotechnologyand biostatistics; performing hazard and exposure assessments at thescreening level; performing hazard assessments, risk assessments andcharacteristics of new and existing chemicals; performing expert analysisof science issues and questions; organizing reviewpanels/workgroups/workshop/symposia; assisting in developing testguidelines/standards; providing automatic data processing, informationmanagement support, and literature and translation support.

In accordance with 40 CFR 2.306(j), EPA has determined that underContract Number EP-W-04-019, SRC will require accessto CBI submitted to EPA under sections 4, 5, 6, 8, and 21 of TSCA, toperform successfully the duties specified under the contract.

SRC personnel will be given information submitted to EPA under sections4, 5, 6, 8, and 21 of TSCA. Some of the information may be claimed ordetermined to be CBI.

EPA is issuing this notice to inform all submitters of information undersections 4, 5, 6, 8, and 21 of TSCA, that the Agency may provide SRCaccess to these CBI materials on a need-to-know basis only. All access toTSCA CBI under this contract will take place at EPA Headquarters and SRC'sSyracuse, NY and Arlington, VA facilities. SRC personnel will be requiredto adhere to all provisions of EPA's TSCA Confidential BusinessInformation Protection Manual .

Clearance for access to TSCA CBI under Contract NumberEP-W-04-019 may continue until March 31, 2009. Accesswill commence no sooner than April 21, 2004.

SRC personnel have signed nondisclosure agreements and will be briefedon appropriate security procedures before they are permitted access to TSCACBI.
