SUMMARY:
This notice announces receipt of an amendment to experimental use permit (EUP) 524-EUP-91 for the Bacillus thuringiensis Cry1Ac protein and the genetic material for its production (vector PV-GMBT01 and vector PV-GMBT02) in soybean from Monsanto Company. The Agency has determined that the amendment may be of regional and national significance. Therefore, in accordance with 40 CFR 172.11(a), the Agency is soliciting comments on this amendment.

This action is directed to the public in general. This action may, however, be of interest tothose persons interested in plant-pesticides or who are or may be required to conducttesting of chemical substances under the Federal Food, Drug and Cosmetic Act (FFDCA),or the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Since other entitiesmay also be interested, the Agency has not attempted to describe all the specific entities that maybe affected by this action. If you have any questions regarding the applicability of this action to aparticular entity, consult the person listed under FOR FURTHER INFORMATION CONTACT.

II. Background
EPA has received from Monsanto Company, 700 ChesterfieldParkway North, St. Louis, MO 63198, an amendment to their EUP for Bacillusthuringiensis Cry1Ac protein and the genetic material necessary for its production (vectorPV-GMBT01 and vector PV-GMBT02) in soybean(524-EUP-91). Notice of the original issuance of this EUP was published inthe Federal Register on June 22, 2000 (65 FR 38828)(FRL-6592-5). The new program increases the acreage by 22.0 acres andadds test sites in Hawaii and Puerto Rico. All soybeans will be grown under containmentprocedures. Plant material and seed produced will be destroyed or used for experimentalpurposes only.
III. What Action is the Agency Taking?
Following the review of the Monsanto Company application to amend their EUP and any comments anddata received in response to this notice, EPA will decide whether to issue or deny the EUPrequest for this EUP program, and if issued, the conditions under which it is to be conducted.Any issuance of an amendment will be announced in the Federal Register .
IV. What is the Agency's Authority for Taking this Action?
The Agency's authority for taking this action is under FIFRA section 5.
